​​Terms of Use and Privacy Policy

1. General Information

 

The Portuguese Gymnastics Federation (FGP) attaches great importance to the privacy of Users on this website and its database, as well as all other means of interaction with members and the general public, subscribing to the imperative duty to preserve the confidentiality of their personal data and other information collected, handled, used and stored about them.

In fulfilling its corporate purpose, in the exercise of its activity, in its values, principles of action and behaviour, and in accordance with the General Data Protection Regulation, adopted and contained in REGULATION (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, FGP is committed to ensuring the confidentiality, integrity and availability of its Users' personal data, whether stored, transacted, structured or unstructured, as well as to respecting their privacy.

 

2. Scope of FGP's Privacy Policy

 

The Terms of Use and Privacy Policy cover the personal information that FGP collects and processes when the Data Subject uses its Platforms and Services, namely any and all information relating to an identified or identifiable natural person, including name, identification number, location data, electronic identifiers, as well as one or more specific elements of the physical, physiological, genetic, mental, economic, cultural or social identity of that natural person.

 

3. Intellectual property rights

 

The contents of the website, including, without limitation, images, text, software, photographs, sound, music, videos, interactive features and the like (‘Content’), trademarks and logos (‘Trademarks’), or any other industrial or intellectual property rights contained therein, are the property of FGP, and their use by unauthorised third parties is expressly prohibited. The content of the website is provided for information and personal use only and may not be used, copied, reproduced, distributed, transmitted, broadcast, sold, licensed or otherwise exploited for any other purpose without the prior written consent of the respective owners. The user declares that they will not use, disable or interfere with features related to the security of the Website and the Application.

The user may, however, print material contained on this website, provided that it is not altered, is for personal and non-commercial use, and retains the source and copyright information, and provided that any other proprietary notices are not removed.

Nothing on this website shall be construed as granting any licence or other authorisation of use to its users.

The website may contain images or other materials whose copyright belongs to third parties, such as suppliers or other entities that contribute to its creation or maintenance (e.g. stock photos).

Although personal data provided to FGP is protected under the privacy and data processing policy contained in these terms of use, any information or other content that the user transmits through this website, whether by email, file transfer or otherwise, will be considered non-confidential and non-proprietary.

 

4. Content and warranties

 

The user agrees that use of the website is at their own risk. To the fullest extent permitted by law, FGP is exempt from any warranties, express or implied, in relation to the use of the website. FGP does not guarantee the correctness or accuracy of the content made available on its websites and assumes no responsibility or liability for any (i) errors or inaccurate content, (ii) personal injury or property damage of any kind resulting from access to and use of the website and application, (iii) unauthorised access to or use of our secure servers and/or personal and/or financial information stored therein, (iv) interruptions or cessation of transmission to or from our website, (iv) errors, viruses, Trojan viruses or similar that may be transmitted to or through the website, and/or (v) errors or omissions in the content or any loss or damage incurred as a result of the use of content published, sent, transmitted or made available through the website (vi) unavailability or any difficulty or inability to download or access content or any other failure in the communication system that may result in the unavailability of the website. FGP shall not be responsible for any assistance or maintenance of the website.

FGP reserves the right to make changes and corrections, change the name, suspend or terminate this website when it deems appropriate and without prior notice to users. It assumes no responsibility or liability for content transmitted between users or between them and any third parties outside this website.

 

5. Liability, use and risk

 

To the extent permitted by law, FGP and all its legal representatives, directors, employees or others who in any way act on its behalf and in its representation, as well as any other party involved in the creation, production, maintenance or implementation of this website, shall not be liable to any user of the website for any possible damage, loss or injury (including any loss of profit and moral damages, any indirect, incidental or consequential loss) arising from the correct or incorrect use of this website and its content, from access to the user's computer, mobile phone/smartphone or tablet or computer system by third parties, or from any viruses, etc.

This website contains links to third-party websites. These links are provided solely for the convenience and easier access of the user. The existence of these links does not mean that FGP has any rights over the content of these websites. FGP does not verify their content and is not responsible for the content of any of these sites or for any fact arising from their use or viewing, nor does it verify that they are free of any viruses or other items that may cause damage to the user. Access to and visits to any of these third-party sites are at the user's own risk, and the user is responsible for any use and/or consequences thereof.

It is expressly prohibited to use the website for illegal purposes or any other purposes that may be considered unworthy of FGP's image. Usurpation, counterfeiting, exploitation of usurped or counterfeit content, illegitimate identification and unfair competition are criminally punishable.

It is also prohibited for the user to create or introduce into this website any type of virus or programme that damages or contaminates it or advises third parties to do so. The practice of such an offence is punishable by law.

The website is controlled and offered by FGP from its facilities in Portugal. FGP does not guarantee that the website will be available for use in other locations. Anyone accessing or using the website from other jurisdictions does so on their own initiative and is responsible for complying with local laws.

 

6. Collection of Personal Data and User Information

 

Through the FGP Platforms, the User's personal information is collected and processed in order to provide them with a service and/or for the purposes of disseminating and sharing information and documents related to Gymnastics, the definition of values, objectives, promotion and development of which, in Portugal and in all its variants, are the responsibility of the FGP.

By registering and accessing the FGP Platforms, the User ceases to be anonymous to the FGP and, as such, declares that they have been explicitly and specifically informed about the processing, handling and use of data and its purpose, expressly consenting to it, as well as having been informed that they may, at any time and by unequivocal act, withdraw such consent.

FGP automatically receives and stores non-sensitive information in its technical records about the User's computer when using its Platforms, whether or not the User has created an account, or is simply browsing FGP's servers.

FGP may collect information including, but not limited to, the User's Internet browser software, the IP address (Internet Protocol) that identifies the User's computer, FGP cookie information, the originating website and the page requested by the User.

FGP may also collect information about the User's location and online activity on FGP Platforms.

 

7. Purposes of Personal Data collection and processing

 

Personal data collected by FGP will be used to manage the membership of different sports agents through FGP electronic platforms, registration for national and international competitions, as well as the respective invoicing and processing of payments for goods and services provided by FGP, the legal basis for which is Article 6(2)(d) of the GDPR.

FGP also uses the information collected for research and development activities aimed at achieving and maintaining a high level of service on its Platforms, personalising the content accessed by the User, contacting the User and informing them of the availability of new services.

FGP processes the personal data collected, either by fully or partially automated means, or by non-automated means contained in files or intended for them.

 

8. Sharing, transfer, disclosure, retention and subcontracting of Personal Data processing

 

FGP does not sell, transfer or make available to third parties, in any way and/or for any reason, including, among others, information technology service providers, consultants and any other third parties that process data on behalf of FGP without the prior and express authorisation of the User and for reasons that are not in accordance with the purposes for which the information was originally collected, or for other purposes authorised by law.

However, the User expressly authorises and agrees to the disclosure of their personal data to third parties whenever:

a) Data processing is necessary for third parties working on behalf of and/or for FGP to provide a service to the User, and those third parties are prohibited from using the personal data provided to them by FGP for any purpose other than to provide the service requested by and to the User.

b) Data processing is necessary for compliance with a legal obligation to which the controller is subject, namely when FGP is legally required to comply with a court order or provide information to criminal investigation or police authorities, in particular for the purpose of carrying out security checks in relation to locations or events to which the User has requested access.  

FGP may allow personal data to be processed, in whole or in part, by subcontracted third parties. Subcontracted third parties are responsible to FGP under the terms of their contract with FGP, primarily for compliance with the rules set out in the relevant contracts and with the General Data Protection Regulation, and primarily in matters of confidentiality and security of personal data.

Before disclosing the User's personal data to third parties, FGP ensures that the third parties have adopted adequate and sufficient security and data protection measures in terms of confidentiality and security and that they act appropriately to ensure compliance with them. and, whenever there are doubts about the guarantee of an adequate level of protection, FGP undertakes to obtain the prior and express authorisation of the User and, within the scope of its internal audit processes, FGP undertakes to carry out regular checks on the processing of data by third parties, especially with regard to the respective security measures.

FGP will not retain personal data for longer than is necessary to fulfil the intended purposes and comply with legal requirements, unless the User expressly agrees otherwise.

One year after the end of the User's relationship with FGP, personal data will be deleted, as soon as possible, with data relating to sporting results and other data considered relevant to the history of the sport or to the future obtaining of certificates or declarations by the User being preserved for statistical or asset management purposes, except where there is a legal obligation to keep the respective records.

                 

9. User's rights to access, update and delete their Personal Data

 

The User has the right to request information about the personal data that FGP collects and processes about them. All requests must be made electronically, using the email address available in the User's personal record, accompanied by the User's telephone number, full name, address and tax identification number.

The User may request that any incorrect or incomplete personal data associated with them be corrected or deleted.

The User may review, correct, update or delete their personal information at any time by accessing their accounts on FGP's electronic platforms or others where the data was created, or, alternatively, they may send a formal request by email in accordance with the above terms to federacao@ginastica.org.

 

10. Personal Data Security and Cookies

FGP wants the Data Subject to feel secure when accessing and using its Platforms. To this end, FGP guarantees that it has defined and implemented the appropriate and necessary technical and organisational policies and measures to maintain the security of personal data, in accordance with the nature of the data processed and the circumstances and purposes of the processing, in order to prevent, considering the technical and IT knowledge available, unauthorised processing, access, alteration or loss of personal data, including identity theft and phishing, with a view to ensuring the confidentiality, integrity and availability of data and the ongoing resilience of data processing systems and services.

FGP recognises the User's rights to be forgotten or to have their data deleted (the data subject has the right to request that their data be deleted), to portability (the data subject may request that the data they have provided to FGP be transferred to another entity, provided that this is technically possible) and not to be subject to any decision made solely on the basis of automated processing.

FGP guarantees that it will notify the National Data Protection Commission within 72 hours of any data breaches that pose a risk to the respective User/Data Subject.

FGP may install and access cookies on the User's computer or any other device. A cookie file is a small set of data that often includes a unique anonymous identifier that is sent to the User's Internet browser from a computer at a site and is then stored on the hard drive of the User's computer. By using the FGP Platforms, the User authorises the use of these cookies, namely to access the User's information when they access the FGP Platforms so that they can be provided with personalised content, track their preferences while using the FGP Services, collect information about their browsing habits when they do not access the FGP Platforms, and for research and development purposes aimed at improving the content and services provided by the FGP Platforms.

 

11. Child and youth privacy

 

FGP is particularly concerned with protecting the personal data of children and adolescents. If the data subject is under 16 years of age, the processing of their personal data is only lawful if and to the extent that consent is given or authorised by the holders of parental responsibility for the child.

FGP will not intentionally collect any personal data from minors without parental consent, nor will it intentionally allow such persons to register as Users.

If the holders of parental responsibility for the child become aware that their child under the age of sixteen (16) has provided FGP with personal data without their consent, they must delete the respective account, and if FGP becomes aware that a minor under the age of 16 without parental consent has provided FGP with personal data, this information will be deleted as soon as possible and the User will immediately lose access to the site.

 

12. Right to complain

 

If they so wish, data subjects have the right to lodge a complaint with the national supervisory authority, the National Data Protection Commission.

 

13. Proof of compliance with the rules on the processing and free movement of personal data - Accountability

 

FGP ensures proof that the personal data it holds is legitimate, limited to what is necessary, and up to date, secure and confidential. FGP ensures that it follows policies, procedures, codes of conduct and internal instructions that can be made available to supervisory authorities and that it has the necessary systems in place to monitor the implementation of such policies and procedures.  

 

14. Data Protection Officer (DPO)

 

FGP, responsible for the processing of personal data on its Platforms, and its subcontractor, where applicable, undertake to appoint a data protection officer responsible for informing, advising and monitoring the data controller and its subcontractor, where applicable, as well as the employees who process the data, to comply with their obligations regarding the protection of personal data, including the allocation of responsibilities, the awareness-raising and training of staff involved in data processing operations and the performance of the necessary audits, cooperating with the supervisory authority, taking due account of the risks associated with the processing operations, the nature, scope, context and purposes of the processing.

Users and data subjects may contact the Data Protection Officer on all matters relating to the processing of their personal data and the exercise of their rights.

The Data Protection Officer is bound by an obligation of secrecy or confidentiality in the performance of his or her duties.

15. Changes to FGP's Privacy Policy

 

Users may consult this Privacy Policy at any time on FGP's Platforms.

FGP reserves the right to make changes to this Privacy Policy at any time without prior notice.

Whenever changes are made, FGP will publish the updated version of its Privacy Policy on its website and other electronic platforms, and the User is responsible for regularly consulting FGP's Privacy Policy.
